These Terms govern your use of the FreshCibo platform operated by Clutch Techs, LLC ("we", "us", "our"). By creating an account or using the service you agree to these Terms.
FreshCibo is a multi-tenant food safety operations and food-holding platform for restaurants and food service operations, including hold timers, label printing, temperature logging, reporting, and related compliance tools.
You must be of legal age and, if signing up on behalf of an organization, have authority to bind that organization. You are responsible for keeping your credentials confidential and for all activity under your account.
You may not misuse the service. In particular, you must not: (a) use the service unlawfully; (b) commit fraud or send spam; (c) infringe intellectual property; (d) interfere with security, including by uploading malware, probing, or scraping; or (e) circumvent technical limits or resell access without our written consent.
Clutch Techs, LLC retains all rights to the FreshCibo software, documentation, and branding. You receive a limited, non-exclusive, non-transferable right to use the service within your selected plan. You retain ownership of your data; you grant Clutch Techs, LLC a limited license to host and process your content solely to provide the service.
We aim for high availability but do not guarantee that the service will be uninterrupted or error-free. We may perform maintenance, modify features, or impose reasonable usage limits.
Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle handles all customer service inquiries related to payment, billing, taxes, cancellations, and refunds. Payment terms, billing frequency, renewals, taxes, and currency conversion are governed by Paddle's Checkout Buyer Terms.
Subscription plans renew automatically until canceled. You can cancel anytime through your account or via Paddle.

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. You may close your account at any time. On termination, we will provide a reasonable export window before deletion, except where law requires immediate deletion.
To the fullest extent permitted by law, the service is provided "as is" without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, Clutch Techs, LLC's aggregate liability for any claim is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability that cannot be excluded by law (e.g. fraud, death, or personal injury caused by negligence).
You will indemnify Clutch Techs, LLC for third-party claims arising from your content, your unlawful use of the service, or your breach of these Terms.
Some FreshCibo features use machine learning to generate insights (e.g. prep recommendations, narrative summaries). AI outputs may be inaccurate and should not replace professional judgment. You are responsible for verifying outputs before acting on them. We do not train shared foundation models on your private data.
We may update these Terms. Material changes will be announced in-app or by email at least 14 days before they take effect.
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles. The exclusive venue for any dispute is the state or federal courts located in New York County, New York.
